Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Return and Refund Policy:

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Anderson Tropicals, LLC, 1345 Hilltop Drive, Naples, FL 34103.

  • Goods refer to the items offered for sale on the Service.

  • Orders mean a request by You to purchase Goods from Us.

  • Service refers to the Website.

  • Website refers to Anderson Tropicals, accessible from https://www.andersontropicals.com/

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.


Your Order Cancellation Rights

To request an order cancelation You must notify Us within 24 hours of the date on which You received the Goods or on which a third party You have appointed, who is not the carrier, takes possession of the product delivered. You must provide high-quality photos demonstrating the reasons for order cancelation, refund, or replacement. Product refunds or replacements are ultimately at our discretion.

Two situations in which we will grant refunds or replacements:

  1. Plant material (i.e., rooted plants with vegetative leaf material) arrives with severe complete breakage to the main stem below the first visible node.

  2. Seed material (i.e., seeds that do not have visible leaf but may contain roots, radicle, and/or hypocotyl) arrive:

    • rotten (i.e., seeds are soft and the consistency of paste when light pressure is applied); or

    • with visible pathogens (e.g., fungal or bacterial).

In order to exercise Your right of cancellation, You must inform Us of your decision by means of a clear statement. You can inform us of your decision by:

We will reimburse You no later than 14 days from the day on which We notify you that Your order cancelation is approved.

Conditions that do not qualify for Refunds or Replacement

  • Weather

    It is your responsibility to check the weather before You order any products. We do not guarantee products will arrive viable when shipped during extreme temperature conditions or natural disasters. Specific temperature tolerances are species-dependent and you should do the proper research to ensure weather conditions are favorable to ship the products you order. A natural disaster can cause shipping in transit delays.

    You may request that we delay order shipment for up to 14 days if the said request is received 24 hours before shipping day (Monday). If You do not believe the weather will become satisfactory within the 14 day period, please contact us and we can work with you to provide advance shipping options, to increase the chances that the products will remain viable. These advanced shipping options do not guarantee the products will arrive in a viable state.

  • State Agriculture Inspections

    If the order is inspected by a state inspection agency resulting in seizure or destruction of the order, you are agreeing to take responsibility if the product gets rejected, confiscated, or destroyed by your state.

 

  • Package Lost/Delay

    We do not take responsibility If the order is lost during shipment or damage occurs to the products due to in-transit shipping delays of the shipping provider (USPS, DHL, UPS, FedEx, etc.). It is your responsibility to contact the shipping provider to resolve such shipping issues.

     

  • Seed Gemination

    We only sell viable seeds so your odds of successful germination are high with our seeds. We do not provide a refund if the seeds do not germinate satisfactorily.

Returning Goods

Due to the nature of the products we offer, we do not accept returns.

Gifts

If the Goods were marked as a gift when purchased and then shipped directly to you, You'll receive a gift credit for the value of your return. Once the returned product is received, a gift certificate will be mailed to You.

If the Goods weren't marked as a gift when purchased, or the gift giver had the Order shipped to themselves to give it to You later, We will send the refund to the gift giver.
